NAB courts are bound to deliver judgment within a year

The NAB Amendment Bill has been passed in the National Assembly by a majority vote.

The NAB amendment bill was introduced by Prime Minister Nazir Tarar in the National Assembly on Thursday and was approved clause by clause.

 According to the bill, several amendments have been passed, including the appointment of NAB chairman and jurisdiction of NAB.

Decisions of the Federal Cabinet are beyond the jurisdiction of NAB

According to the bill, federal or provincial tax matters have been removed from the jurisdiction of NAB while in case of non-receipt of direct or indirect financial benefits, the decisions of the federal and provincial cabinet will not come under the jurisdiction of NAB.

Irregularities in any development project or scheme will not come under the purview of NAB while NAB will not be able to act on the decisions of any regulatory body unless there is a direct or indirect financial benefit.

Procedure for appointment of Chairman NAB

 On the retirement of the Chairman NAB, the Deputy Chairman will be the Acting Chairman. In the absence of the Deputy Chairman, any senior officer of the institution may be given the charge of Acting Chairman.

According to the bill, the appointment of judges in the accountability courts will be for a period of 3 years while the removal of a judge of the accountability court will require consultation with the Chief Justice of the concerned High Court.

The consultation process for the appointment of new Chairman NAB will be started 2 months in advance while the consultation process for the appointment of new Chairman NAB will be completed in 40 days.

According to the text of the bill, in case of disagreement between the Prime Minister and the Leader of the Opposition, the matter of appointment of Chairman NAB will be referred to the Parliamentary Committee.

The parliamentary committee will finalize the name of NAB chairman in 30 days. After the 3 year term of Chairman NAB, the same person will not be re-appointed as Chairman NAB. The power to appoint Deputy Chairman has been given to the President and the Federal Government.

Under the new law, the duration of NAB inquiry has also been fixed, according to which NAB will be bound to initiate an inquiry within six months. The arrested persons will be required to be produced in the NAB court within 24 hours while no arrest can be made with the filing of the case.

According to the bill, NAB will ensure availability of solid evidence before arrest. The NAB law has been amended to reduce the remand from 90 days to 14 days. While the right of appeal for the accused has been reduced from 10 days to 30 days. If the case against someone is proved to be false, the responsible person will be sentenced to 5 years imprisonment.
